    Default Another Am I still Married question.

    My husband and I were married in 2002. I kicked him out in Dec. of 2003. He went ahead and filed for divorce in March of 04, but we decided to try to work things out. Needless to say we didnt work it out and havent seen each other in 2 yrs. The divorce proceedings were recently dismissed because no action had been taken. I do have the capability of looking up records online and find nothing that shows he has tried to file for divorce again. Because of those capabilities I have found out that he has filed for a marriage lisence to another women. I am just wondering if he has filed somehow without me knowing. I have not been served with any papers. I have moved, but live in the same town as always and have the same phone number and job. Are we not still married, and if he remarries isnt that bigomy?

    Knowingly getting remarried before you are divorced is bigamy.

    If your husband filed for divorce in 2004, check with the court where the divorce was filed to see if they show the entry of a judgment. Otherwise, the fastest path to finding out what happened is probably to ask your (ex-?)husband.

    There is nothing showing an entry of judgement, just a dismissal. When we tried to reconcile, the attorney said that the case would stay on the docket for a year unless something was done otherwise. I know I have not done anything more, and I am pretty sure he hasnt either. The only reason I havent persued the divorce is due to financial reasons.
    The thing that bothers me the most is the woman he married(?) probaly has no idea that he is/could be still married to me. The reason we split was because of his pathelogical lying. I am clueless as what to do now.

    If your ex- can't point you to the divorce judgment, you may wish to bite the bullet and file for divorce. Granted at this point it appears he would be the primary beneficiary while you would be paying the filing fee, but at least you get closure.
