    Default Sent Home and Fired Due to Migraine Medication

    My question involves labor and employment law for the state of: Ohio.

    I am prescribed medication for my migraines, I called into work informing them i was on the medication and the directions advised me not to be at work. They stated either i come in or lose my job so I went in. After being there they saw the effect of the meds and sent me home. Later my boss informed me I was fired for bieng drunk at work, and is refusing to give me termination papers stating the reason I was fired.

    So, what are you asking us? If your termination was legal?

    Ohio, like most other states, is an "at will" employment state. You can be fired for getting out of bed in the morning.

    Are you asking if you're eligible for UI? Apply and find out. Your employer will probably fight it, but with appropriate documentation from your doctor, you ought to be able to win on appeal.

    Even under the ADA, the employer is not required to permit behavior that would not be permitted in a non-disabled employee.
