    Default Property Damage

    My question involves court procedures for the state of: Michigan

    I live in Michigan and about 3 months ago the x-wife of my boyfriend dragged her key down my car and then made a scribble mark. All of which I got on video that she knew I was recording. Police were called and a report made. I have recently filed a lawsuet in small claims, where her defense clearly states she DID key my car but that it should be void becaue it was three months ago and because my vehicle is an 88 blazer (it's actually a 94, but either way....) My question is.... if I am suing her but my vehicle is clearly older and doesn't have a brand new paint job, will the judge even feel I deserve any money? I guess I'm worried he will think that since it's an older vehicle than she doesn't need to pay me (since I'm obviously NOT suing for a paint job of any kind). Like I said, she does admit to it, I have video and pictures, but will I get money for the simple fact that she damaged my property regardless of it's actual value. ??? Any help would be great.     It isn't about the value of your Blazer. It is about the value of the damage caused and age has no bearing on this. She intentionally caused damage and therfore is financially responsible.

    If it were me, I would be pursuing criminal charges of willful or intentional damages as well as the financial aspect.

    Thanks for your response zedex. I'm just nervous about the case (it's tomorrow, the 22nd). I didn't know if the judge would be looking at me weird because I'm not looking for the money to fix the damage, just because she caused the damage. But hearing from you made me feel better!

    Well I sued for $500, but I knew going in there I wouldn't get that much. I ended up with $150. And she was pissed!! So it was worth it! She tried to use excuses in court, like "please consider my emotional state at the time when you make your decision.." Because she thinks he x-husband left her for me. And she lied in court saying it was an 88, and looked at two pictures, one was a farther away view, the other a close up view of the same scratches and said she did the one set of scratches but not the other!! And her mom stood up as a witness, who wasn't there when it happened, and hasn't ever met me or seen my blazer, and told the judge she believed her daughter was correct in that it was an '88. AFTER I already told the judge it was a '94, and that I had the police report (where they take your vehicle registration) with the correct yr. on it. Anywho... I could go on forever. I think karma took care of it anyways, cause she rear-ended someone two days after she keyed my car and messed up her hood!! And I found the pics. of it, so I look at those when I need to see justice!! Anyways, she has no job and gets 80 bucks a week in child support, so she sent me a motion for installment payments, where she wants to pay 5 bucks a month. GET A JOB!
