    Unhappy Florida Child Support and the Age of Majority

    Hi...

    I actually live in Puerto Rico with my mom, my dad lives in Florida. A couple of days ago I recieved a letter from my dad's lawyers claiming that in 2007 I reached age (18) of majority(emancipated) and that the money I received through child support since that date then, I was supposed to pay it back. I'm in college right now and I'm 19 (I don't know if that helps, but here in Puerto Rico it does.) .Another thing, he owes me like almost $15,000 of child support. Now I'm supposed to pay him what's rightfully(I think) mine? please help me with this.

    some facts you may find useful:

    In Puerto Rico, age of majority is 21.
    In Puerto Rico, it does not matter if you are 21 if you are a college student to receive child support.

    * Is that debt erased if I reach age of majority?

    Child support is for the person caring for the child. I'm shocked a lawyer would send this letter to you and not your mother. If your father owes back support then your age does not erase that debt.

    So, in other words, my mom should be the one to pay that "debt" they are claiming, but the debt my dad has is not erased by my age so, she doesn't have to pay anything?

    First, was the CS order issued in the state of Florida?
    If it was, the attorney is correct, CS was supposed to end at age 18.
    However, unless the court order was HIGHLY unusual, the attorney was NOT correct that YOU owe anything. Your mother would owe, not you.
    Even then, it's possible that your mother won't owe, depending on the exact wording of the court order.
    Your Mother needs to read the order, and if need be get a consult with a FL attorney to see if she would have to reimburse for any overpayments. She can get a phone consult by calling the Florida Bar Lawyer refferal Service at 1-800-342-8011.

    You mentioned him owing YOU $15,000.oo in CS. (it's owed to mom, not you). Are you saying that he owes that much in arrears? (money that was court ordered, but not paid?)
    If so, your Mom definately needs to speak to an attorney ASAP.

    But Xena, if there is still a debt, even if I am 18 years old, doesn't that mean that my dad still owes my mom then?

    Child support goes to the custodial parent. Not to the child. Have your custodial parent post so that we may ask her the details in order to give accurate advice.

    IIRC, all CS in Florida now goes through CSE, and has for some time. If you are getting letters about overpayment, it is probably coming from them.
