    Default I Never Received Keys to My Apartment - is That a Breach of Contract

    My question involves landlord-tenant law in the State of: Minnesota


    I signed a lease with a rental company in April. This is a 4 bedroom apartment and there were 3 people that originally signed

    Two weeks later I decided to move to a different state next year with my boyfriend and called the rental company to tell them my intent to do so and see what I needed to do to get out of the lease. The Landlord said I could get out of the agreement if I found someone to take my place.

    A couple of weeks later another girl that originally signed the lease decided to not live their either and she was given the same stipulations on getting out of the lease as I was.

    The third girl, in the meantime, found another girl to move in. I had originally signed a lease for the apartment and in the lease it says for room 4 in that apartment.

    This other girl, girl number 4, chose girl u number 2's room, me being number 1, the second girl to want to move out number 2 and the girl that has been there all along number 3.

    Im sorry if that is confusing.

    Anyways, girl number 4, the new girl chose girl number 2's room and because of that girl number 2 has received her full deposit and last month's payment back and has not had to pay for June.

    Me, on the other hand, I have paid the deposit and last month's rent along with June's rent after the landlord called threatening me if I didn't pay.

    My friend, an undergraduate pre-law student thinks that I would have grounds to fight for a contract breech because the landlord has not fulfilled his end. I have no way of getting into the place or my room because I have not gotten the keys or anything from him. I have been paying the rent for a place I cannot get into.

    I guess my question is, is there anything I can do to get my money back. My deposit or last month's rent or the may 2010 rent? He is not making this other girl pay because the new girl chose her room and not mine. Even though I wanted to leave first.

    Please help!!!!

    Ask the landlord for keys so you can move in. I'm sure he'll be happy to give them to you.

    Obviously I do not want to move in, but thanks for the expert advice it was REALLY helpful!
