    Default Is the offense of Renting or Wardrobing prosecutable?

    I am looking for information on laws and penalties concerning the Renting or Wardrobing of retail merchandise.

    From Business Week - August 2005
    Renting/Wardrobing:
    An item is purchased legitimately, used or worn and returned as if new, enabling the purchaser to "rent" the merchandise for free.

    I am trying to convince my friends that you can not buy something with no intention of keeping it, use it, and than return it and in doing so you are commiting fraud. I know it is fraud but what can you be charged with?

    This is Ohio, however any information is welcome.

    One of the problems with this type of conduct is that it is hard to prosecute. How do you prove what the buyer intended, and if the return is consistent with store return policies how do you establish that they did something wrong? I'm not sure that the law has caught up with this particular trick.

    I used to work LP at Saks Fifth Avenue in So. Cal and this was a regular problem. Some of the rich bit*#es would get designer dresses for prom or fancy shmancy dinners, wear them and return them in a few days. Sometimes there would be lipstick marks, wine stains, food stains and B.O. on dresses in the $1,000.00 to $2,500.00 range. On occasions they would take a small scissor or knife and cut the material or open the seam, so it was 'defective'. No law against a return with a receipt, it shows how little class some butt heads have, but not against the law.
