My question involves a child custody case from the State of: Indiana

If a divorce settlement involving an adopted child being left in the custody of the biological mother and the child decides to remain in the care of one of the adoptive parents, who has custody of the child if settlements are never changed?

If the child was adopted and the mother's parental rights were terminated as part of that process, the mother has no parental rights. You don't explain this situation at all well, but if mom lost or gave up her rights as part of an adoption after her divorce, the custody provisions in her divorce had no relevance past that date.

The bio-mom gave the child up, but lived alongside the child (the child knowing she is the mother) and when the adoptive parents divorced custodial rights were transfered back to her through the adoptive parents' divorce settlements. The settlements have never been changed nor were steps taken after the divorce to change custody.
