    Default Developer's Assessments on Unsold Units

    Illinois

    Small association of 20 units. After two years and burgeoning legal costs, board ceased legal action against developer for assessments on unsold units and fired association attorney. Board has now informed association that each owner must pay, for his individual unit, what the developer did not pay on his unit from first sale until said owner purchased the unit -- the developer's assessments on unsold units.

    Is this legal and enforceable?

    We can't read the various contracts, documents, bylaws, records of prior court proceedings, etc., to determine the parties' rights. Take them to a lawyer and have them reviewed for an opinion.

    I agree that the documents have to be read. However, the Board probably surmised that it was cheaper to cease any type of legal action with the developer and instead have the owners pay. What difference does it make? Owners would either have to continue paying huge legal costs or they would be assessed for the unpaid fees of the developer. The owners would pay in the end regardless and the Board probably figured they were giving the owners the lesser of two evils.
