    Default New Jersey Divorce

    What are my rights in NJ? Been married 14 years, 2 minor children. He won't move out and won't get therapy. My only option is to move out. I pay all the bills, manage the home. When I leave I am leaving all this responsiblity on him. I realize this may ruin my credit, but at this point don't care. What are my rights to the home and bills? Tired of threatening to leave with the kids, and am now folloowing through on those threats. I will not keep the children from him - just can't live in the same house anymore.

    I suggest you consult a divorce lawyer. It may make senseto stay in the home when you file for divorce, both in terms of economics and in terms of making a claim to live in the marital home after you divorce. Not to mention, it can be difficult to fund a separate household suitable for two kids, and if you move out without the kids you put yourself at a potential serious disadvantage in any custody litigation.
