My I-140 and 485 were denied in September last year because I didn't know that they requested more evidence and my lawyer did nothing at all when she received RFE. Then, she told me not to worry and she would resubmit the case. However, she never did so until April 2009 I received a Notice to appear for removal proceeding.
After that I consulted a few law firms and were told that I lost my status since I-140 was denied and resubmission wouldn't help me at all even if it was filed.
So I changed my lawyer and got a new law firm which is very good at explaining my situation and their strategy for the case.
The new law firm filed a complaint against my prior lawyer to state authorities and we will argue that it was out of my control and it's my prior lawyer's failure. If she notified me RFE or she appealed the denial, I would still have my status.
How much hope do I have to win this? The fact is that my prior lawyer did make a big mistake and that I was so ready to give all the documents DHS asked. However, I don't know what's gonna happen in the court. I'm very scared. Do you think my argument is possible?
