    Default California, Right Turn, No Stop on Red, Photo

    My question involves a traffic ticket* from the state of: California

    I got photoed today in El Cajon, I had never been to the area before and was turning into a mall parking lot and I may or may not have ran the light (the flashes went off for me and a guy in front of me.)

    I don't know anything about a possible ticket yet, but what, if anything, should I do about it. One of my friends says that its a pretty popular place but she knows about someone never getting cited after getting photoed at the same spot.

    I can't handle a ticket right now, and I need some advice.

    There is nothing you can do right now to "avoid" it... If it comes, post the details and you can go from there...

    I got the ticket today. I'll try to explain the details as well as possible.

    I have the pictures of me failing to yield for a red light, and it says it is a violation of California Vehicle Code Section 21453(a) or (c) pursuant to Section 21455.5.

    I received two papers and a return envelope, both of them say Notice of Traffic Violation, and one of them has 4 pictures showing me failing to make a complete while making a right turn at a traffic light.

    It gives me a date to appear in court, but where it says "bail amount" it says to refer to the Court's Courtesy Notice, which on the other paper says may arrive within ten days.

    That same paper has a form where you can identify a new driver if you weren't driving the car.

    If you need more information I'll provide it.

    It also states the address of the court.

    I can tell you what the bail/fine amount is but I hope you're sitting down because it is expensive.

    The base fine is $100 but after adding the penalties and assessments it adds up to $435, which may vary slightly by county. If you choose to go traffic school so as to have the ticket dismissed off your record upon completion then you can add an additional $49 to the fine amount which comes out to a grand total of $484.

    You can skip that part... If you were the registered owner of the vehicle but is not the driver pictured on the citation then they're asking you to identify the driver... But if you were the registered owner and yet you were not the driver then there in nothing in the vehicle code that states that you must identify the driver. And there is nothing they can do to force you to identify who the driver was. That is their job to find out who it was not your job to tell them.

    The only thing left to ask and the only thing that can save you from having to pay this fine if if you were not the registered owner of the car...

    So are you the registered owner?

    And is the citation issued to you in your name?

    I am not the registered owner of the car, and it is not cited in my name.

    Well, good for you...

    The registered owner takes the citation, goes to court, when his/her name/case is called he goes up as instructed, and when asked for a plea, he/she should say: "I plead not guilty, your honor, I am not the person pictured in the citation". The judge will ask him/her for their identification, compares the picture on the citation, with the picture in the ID and compares both to the person standing before him/her... "Case dismissed".

    Do not under any circumstances assume that the registered owner has any obligation to inform the judge or anyone else for that matter who the driver is.

    And obviously, you don't wanna show your face in that same courtroom on that same day!

    You got lucky this time... Drive careful.

    Is it possible to have the case dismissed through the mail?

    I assume it would be through mailing the court and not the police department, but it would be great if we could say that through the mail.
