    Default MIP when I Didn't Drink

    My question involves criminal law for the state of: Oregon

    i am 18 years old, on the night of the 11th i was cited with an MIP, i was with my friend in his car (he was driving) he had just picked me up from my house, we dropped his friends off and made a wrong turn to a park, while turning around we were stopped by the police, my friend was taken from the car and arrested after they saw a bottle in the back of his car that i didnt know was there. they asked me to step out of the car and to sit down, i coraporated, and about 10 minutes later the officer informed me that i smelled like alchohol and that i had been drinking, i was never given a field sobriety test or a breathalizer, yet i was given an MIP for consumption of Alchohol, can i fight this, please i need any bit of help, this just seems wrong that they can tell me i was drinking when i was not, and not prove it.

    You fight it by trying to convince the prosecutor or court that you weren't in the park to drink, didn't know the alcohol was present, and didn't in fact smell like alcohol. I suggest getting help from a criminal defense lawyer.
