    Default Texas Laws on Statutory Rape

    My question involves criminal law for the state of: Texas

    My younger sister was 16 at the time when she had her child. The father of the baby was 18 yrs old. The child is now 10 years old.

    Since the mother was very young at the time, does TX law have statutory rape for cases like this? Also, what is the statue of limitations?

    Texas does have statutury rape laws. See

    Included in those laws is a "Romeo and Juliet" clause, allowing a 3 or up to 5 year age difference window (see 21.02(g) and 21.11(b)) under which he has an affirmitive defense.

    So, this case would not apply to her because he was only 2 years older? She was a minor at the time...16 yrs old!!

    Is there anything she can do to have him stay away?

    From your other thread, it sounds like her primary concern is to try to get out of paying child support.
