    Default Seeking a No Objection Statement Before or After Applying for J1 Waiver

    I am a bit confused and would love some help...When applying for the waiver for the 2 year home rule- i have requested a no objection statement from my UK embassy by filling in a form and posting it to them, what i am unsure of is do i wait for them to agree to the no objection statement before i submit the waiver forms and processing fee to the US embassy? or do i just go ahead and submit them even though i am not certain my embassy will grant me a no objection statement? I have tried calling my consular section but just get automated service and am never able to speak to anyone. how will i know if my embassy will grant a No objection statement?

    You must have a waiver (or, in the case of a no-objection waiver, a favorable recommendation letter that you can attach to your I-485 along with a notice of action (NOA) for your I-824) before you can file I-485. You must produce your waiver at the interview.

    The instructions to form I-485 state:
    Quote Quoting Who Is Not Eligible to Adjust Status?
    10. You are or were a J-1 or J-2 exchange visitor and are subject to the two-year foreign residence requirement and you have not complied with or been granted a waiver of the requirement;
