    Default Ex Girlfriend Changing Son's Name

    Hello, I live in Volusia County florida, and my ex girlfriend has decided she doesn't want my son to have my last name and wants to change it. She asked me if I'd sign to change his name and I said no. She then told me that she was going to forge my signature, and that her aunt was a notary and would notorize it without witnessing my signing it....is this possible? Can his name be changed without anyone wanting to see for themselves that the father did in fact give permission? My son is 2 years old.

    Cut and pasted from the Florida Statutes:
    "117.105 False or fraudulent acknowledgments; penalty.-A notary public who falsely or fraudulently takes an acknowledgment of an instrument as a notary public or who falsely or fraudulently makes a certificate as a notary public or who falsely takes or receives an acknowledgment of the signature on a written instrument is guilty of a felony of the third degree, punishable as provided in s, 775.082, s. 775.083, or s. 775.084."

    Felony of the third degree has a $5,000 fine.

    So, does that mean she can follow through and his name could in actuality be changed before I'm able to prove she forged mt signature? What would do if she actually does it? Who do I contact?

    Any and all advice is appreciated..

    If the felony occurs, start by calling the police.

    Keep an eye on your local court filings. She will have to file a petition for name change, as soon as it shows up as filed, you should file a response with your objections.

    I assume you mean family court? Should I call them and tell them of her threat? And then keep calling to check?

    You can do an on-line search of filings at:

    http://www.clerk.org/cm/publicrecords/publicrecords.jsp

    If she files anything in Volusia County, it will show up on-line. Or, you can go to the civil court clerk's office yourself to search.

    Since there are several counties in the Seventh Judicial Circuit, you might want to keep an eye on the court clerk's sites for Flagler, Putnam, and st. Johns counties also, just in case she files in another county. (which she shouldn't be able to do, but I've seen it happen in the Tenth circuit)
