    Default Commercial Notice to Quit 45 Days

    My question involves landlord-tenant law in the State of: Georgia

    I am renting a Commercial space, and have gone from a lease to month-to-month. My landlord informed me that she would be sending a 45 day notice. I had understood that 60 days was required.

    She claims that the law is 45 days for month-to-month agreements.

    The only information I can find is regarding residential rentals, which indicate 60 days is required. Is it different for commercial property?

    It does appear that Georgia Code 44-7-7 requires sixty days notice to terminate your lease. In many states, for commercial leases, the notice period can be modified by contract - and there may be such a provision in the lease you signed with the landlord that applies even after the expiration of the initial lease term (although I don't know if there is, and I can't tell you if it's enforceable as written).
