My question involves criminal law for the state of: California
I was arrested a few nights ago while walking home from the bar in Tahoe City (Placer County). I was not combative or causing trouble. However, I was definitely stumbling and obviously intoxicated. I was arrested for Drunk in Public. What worries me is that I am on the basic unsupervised probation from a DUI which I got a little over two years ago. The probation was for a term of 3 years and basically says that I can not consume alcoholic beverages. The DUI was my first offense until this Drunk in Public charge.
It looks to me from my initial research that my punishment is largely up to the judge. I have a court date set for next month in Tahoe City. If anyone has any experience with something like this at the Tahoe City Court please let me know.
It does look like in a lot of these cases the Drunk in Public charge is thrown out. However, I'm guessing I will probably not be so lucky considering the probation. FYI, the DUI came from Truckee which is Nevada County. I doubt that helps but thought I'd throw it out there in case anyone has any experience in these circumstances.
