    Default Equal Rights Amendment

    Assuming the ERA had passed, if a suit were brought before your court by a man to force a woman to not have an abortion, except to save her life now, I am talking about a simple non wanted pregnancy, would you as a jurist say the ERA gave men "equal reproductive rights" and would you order the woman to not have an abortion if the father requested it in his complaint!


    Section 1. Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex.

    Section 2. The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.

    Section 3. This amendment shall take effect two years after the date of ratification.

    I think he might be referring to those laws that allow for criminal prosecution if you cause injury to a pregnant woman and cause her to miscarry - IIRC, they allow homicide charges to be brought forth.

    I ain't touchin' that one, either.

    You're not asking a "simple legal question", Bill. You're inviting - pardon the rough language - a shitstorm over a topic that people feel compelled to drag religion and other irrelevancies into, and devolves rapidly into ad hominem attacks.

    Nothing productive ever comes of these things, all you get is a whole bunch of people screaming and pissed off at each other.
