    Default Looking for 'Bottom Line' to Possible Sentencing

    I've recently been arrested for theft by unlawful taking and recieving stolen property. It's a third degree felony because the item taken is valued @ $2500.00 I am a first time offender. I have never been involved with authorities before except for a few minor traffic tickets. I am a HS/college graduate, I'm in school again, I am currently employed, etc. The max they are giving is 7 years and 15,000 for each violation. I never pictured myself in this position and I guess I am still in denial that I can actually go to jail for this. I have been extremely cooperative with the cops in everything. I was set @ $5000.00 unsecured bail. My prelim hearing is not until March 30th and I do not meet with an attorney until this Mon. Is there any bottom line anyone can give me to what my sentencing may be like? Is there ANY possibility for probation? Or fines?

    Or am I indefinitely facing jailtime?

    Default Not a lawyer or even expert, but from my personal experience

    it’s all going to depend on how good your lawyer is, how badly the prosecuting attorney wants to stick it to you and what kind of mood the judge is in that day.

    I was arrested for felony shoplifting value over $250 in VA. First time offense. The state’s Attorney’s office agreed to a plea of misdemeanor IF I agreed to serve 10 days in jail. I refused, stupid decision I know, and pleaded guilty to a felony charge and was the most respectful defendant in the world, broke down and cried like a baby at my sentencing hearing (I really was emotionally distraught) and the judge sentenced to me to 1 year unsupervised probation.
