    Default Tenant Issues - VOSC & MBS Properties

    The Villages of Sage Creek apartment community, owned by MBS Properties, is nothing more than slum apartments owned by a slum lord. I know someone here who got attacked by pit bulls. Nothing was done by the manager or anyone else affiliated with MBS properties. The gates are always broken; there are always mountians of trash piled up around and in the garbage bins; the security door is broken leading to the workout room and the sauna, etc.

    We had to call the police while working out one night b/c some high-on-drugs street kids were trying to force their way into the workout room. They returned just a few nights later to again disturb residents in the workout roomdespite the police warning they had received. Even with a pit bull attack on residents, the apartments, The Villages of Sage Creek, (a.k.a. MBS Properties) won't let anyone out of their lease...AND they force residents to give a 2 month notice in order to move at the end of their leases. (It's in fine print on the contract.) So, my family and I don't feel safe living here, and it's like we worry about what will happen next on a daily basis. The residents who were attacked have tried to talk to the manager about the pit bull situation, and she avoids their calls. They finally asked for the regional office number, and the air heads working in the office wouldn't give it to them.

    So, we started researching MBS properties on the Internet to see what we could find out on our own. We were shocked to see that many many people are upset and furious with MBS and have complained about them. Many of those same people have tried to file lawsuits against MBS properties, but the company representatives "avoid"...even by not showing up in court. I've lived now in two MBS properties (since they were so eager to have us transfer when we moved the last time). There are huge and similar problems with all of their properties... danger...
    garbage piling up to the size of a small hill...broken security gates and doors...the list goes on and on.

    These apartments are owned/managed by REAL SCUMBAGS! Do a google search and see what you get. I doubt any of them even finished high school. They also lie about whether or not the manager is available. They are ALL A-1 scumbags! I've never seen such white trash in my life.

    Did you have a legal question? There are other forums more suitable to criticizing landlords and their staff.

    Yeah, I do have a legal question, but if you are not an attorney living in Texas, how can you help me? If you can't help me or anyone being victimized by MBS Properties and their owners/management, why is it your business? Check the previous post asking for information regarding MBS Properties (before mine)--maybe you can offer your expertise to all of them also.

    All I Have To Say I Live At The Park At Walnut Creek In Austin Tx. How Do These People Keep Buying Properties And Screwing Everyone Over. I Have Had A Water Leak In My Ceiling Since June 2005 It Has Not Been Fix Nor Checked For Mold. The DOg Park Is Sick And Smells Bad, Pools Are Bright Green, The Gates Have Been Broke For 7 Months Now, They Have Pad Locked The Pool Gate And The Game Room Doors (which We Pay For Access To) The Trash Is Unlivable There Are Nate's, Maggots, Rates And I Have Found Out Water Moccasins Are In There, I Called The Health Department Today And The Gave The Apt A Deadline For The Trash Which Is Tomorrow. If It Isn't Cleaned Up The City Of Austin Is Going Have A Contractor Come Pick It Up And They Also Told Us They Are In Court Right Now For A Lot Of Other Health Issues But They Couldn't Tell Us WhY. It Makes Me Mad To No End And No Matter How Much We Do,complaine,call Nothing Happens. We All Just Get Screwed And Our Money Stolen From Us. It Just Isn't Fair But I Don't Know What Else To Do. I Would Really Tell Everyone To Stay Away From Mbs They Are Thief's, Liars And Anything Else You Want To Call Them. How Do People Work For This Company Is Beyond Me!

    These people are right Mr. Know It All. I unfortunately live in an MBS property as well. The trash is piled up causing a health and safety hazard. The security gates have not worked in months. The pet park is not kept up to standard. The pool has been green. I live in the same complex as dani. I want to move out myself. I only have until October left in my lease and then I am moving. There is also trash by the mail boxes. People do not pay decent money to deal with those kinds of conditions.

    If you look up their properties and the management under the Better Business Bureau, they have an unsatisfactory record. Fox 7 is doing a story on The Park at Walnut Creek. The management also has a deadline to get the trash taken out. No trash pick up for months is ridiculous.

    The management has not been helpful when called about maintenance and safety issues on the property. All they say is "We are trying to get a vendor" every time someone tries to get an answer from them.

    My advice is to contact the Better Business Bureau if these problems do not get resolved. Keep calling the City of Austin Solid Waste Services too. The property is being monitored over the next 6 months for the trash issue. Also go to www.mbscompanies.com for corporate information. I have my ducks in a row when it comes to moving out and getting my deposit back. Make sure you take pictures of the dwelling, have a neutral witness, and have someone from the staff tour the apartment to make sure it is in clean condition when moving out. I hope this advice helps. Make sure to find out where your local Small Claims Court is as well if you have to go there for the deposit.

    I live at Walnut Creek as well. I originally moved in to my unit in November 2004 when the property was owned by Amli. Since MBS took over the property it has steadily gone down hill fast. 10% or more increases of rent have been the norm when it is time to renew and the company actually has the gol to hand you a list of features available.. except the list actually is for the property next to ours which sadly is also owned by MBS. I avoided a major raise in rent because I identified that the list handed to me did not reflect my complex and I was prepared to mount an assault on the front office for passing this off on my wife and I along with a good number of work tickets that had not been acted upon.

    However the trash pick up and the pool situations have me very concerned. It's one thing for me to be minorly bothered by a garage door issue when compaired to the mountainous pile of trash that one can see easily from the road out in front of our property. not to mention the health code violations and risks to the public health in general.

    Where does the increases in rent go? Perhaps it's to severance packages to the ever changing office staff.

    The property that I live at enforced a landlord's lien on property for a delinquent - water - bill. In one case a 52" TV for a $30.00 bill. Liens are not legal for delinquent water bills - only rent (It states "rent" in the lease agreement). Can anyone see teh theft that is going on, or is it just me? They will see me in court FOR SURE.
