me and my boyfriend have been dating for 10 months and we are looking to get engaged at the end of the year. The only problem is that he is out of status. He came in on a B1,B2 visa and it has expired. He says that he is on his mother's perminent recidency case and it has been approvedm, but US immigration needs the original documents that her lawyer has. The lawyer says that she is not going to give him the originals because his mother is in their native country without permission. The lawyer told them if she comes back to the US she will write up a letter stating that it was an emergency leave and then things will proceed as they should. Does the lawyer have legal rights to withhold documents that the mother obtained before she ever consulted with him or her, and has granted premission for them to be released to her son? can he be deported since his mother has left? if we get married will it make a difference as to weither he stays or not?
