    Default Used Vehicle Dealer Liability

    My question involves a consumer law issue in the State of: Rhode Island
    I bought a 2000 Hyundai with 38000 miles from a dealer in RI. After 2 months and less than 1000 miles, the timing belt broke and ruined the engine $3600 to fix. Dealer refuses to help states 30day, 1000 mile warranty> What about implied warranty? Should I have to pay to repair?

    You had an express warranty.

    By their nature, timing belts wear out and break. If you drove the car for two months without any sign of a problem, how would the dealer have known?

    My thought is they are engaged in the auto business, these are service items that should be checked prior to sale. Manufacturer states 4 years or 40,000 miles, should have been checked with alleged maintenece and safety check prior to purchase?

    you might want to contact Hyundai and let them know that they need to improve their belts or change the recommended change limits.

    as to the dealership: there are no outward signs of a timing belt deteriorating nor are they required to ascertain maintenance records. Since the vehicle was over 4 years old, it was part of your due diligence to ascertain if the belt was changed when it was supposed to be (actually, it should have been changed twice by now due to the vehicle being 9 years old) and if not, to change it before driving it. You failed to perform your due diligence and as such, you are now the proud owner of a Hyundai that needs a new engine.
