    Default Landlord Kept Deposit After Writing No Damages on Date of Move Out / Return of Keys

    My question involves a security deposit in the State of: Arizona

    I had problems with the landlord who is not the owner getting pool service and he kept me from using the pool for a couple of months. We went to court over this twice and the judge finally told me to pay the pool service and get reimbursed from landlord. The landlord stopped reimbursing me and I took part of the monies he owed me off my last month's rent. My last month's rent was late as I was unemployed but it also didn't get postage put on it at the UPS store that sent it certified mail for me and came back to me when I called the Landlord to tell him what had happened he said we were going to court again and he would not accept the payment. He filed the paperwork that afternoon after I had been to the court house to find out that there was no court paperwork yet. He said they spelled my name wrong that is why they couldn't find it but in all actuality they filed it that afternoon after I had been in the courthouse. I also had a washer and dryer that tore up my clothes and had been switched after I had looked at the place. I sent a 5 day notice twice but nothing was done. The judge that heard about the pool and the washer did nothing to this landlord and will be the same judge hearing my deposit case . . . so therefore I am worried as I don't think he did right by me before. Making me pay twice for the pool service as it was to be included in my rent. But the fact of the matter is I have a signed sheet of paper stating NO Damage noted at move-out walk through. The address of the property I rented and the date and his signature. This happened 12-2-08 and he didn't return most of my $1286.00 Security Deposit. He kept over $1000. I found out from the court house the same judge will be hearing this case. My question is can I still file a case or is it too late??? Is there a statue of limitations for security deposits in Arizona??? I moved to Indiana and he knew I was going to do this so that is why he didn't send what little he did back until the 17th and I was leaving on the 20th which I had to go to the Post Office before leaving town to pick it up. I would like to file for security deposit, loss of use of pool, and washer ruining my clothes and switch of washer and dryer from picture in ad (new ones) to picture I took of old ones. I also have pics of the house on digital camera. I am unemployed and LOW ON FUNDS so no lawyer will be with me so I need to know what I need to do. I am a GREAT TENANT who doesn't wear their shoes, put their hands on the walls, smoke or drink or have parties. It is usually just me and my stuff. I left the place in better condition than I got it!!! UGH~!! Please help me!!!

    Use normal sentences and paragraphs.

    If your landlord owes you money, consider filing a counterclaim in the present lawsuit.
