    Default Fiance Visa

    Hi,

    Can somebody tell me, what is this "Fiance visa". Can the Fiance travel to US and get married there? Even if, the fiance is not a citizen nor working in US?

    A fiancé visa is a visa that allows the fiancé of a U.S. citizen to come to the United States, marry within 90 days of entry, then seek adjustment of status based on marriage.

    You don't need a special visa to simply marry in the U.S. - for example you can enter as a tourist, marry your fiancé, then return home.

    Thanks for your reply.
    Now my query is, my fiance is in US on H1 and is waiting for his greencard. Can he still sponsor me to come there on Fiance visa? Or else, what is an alternative that we can get married.

    Well, one of the requirements of the K-1 (Fiance) visa is that the person who petitions on behalf of the foreign fiance(e) must be a US citizen. A US permanent resident, for example, cannot obtain a K-1 visa for a foreign fiance(e).

    Are you asking how it's possible for you to get married, or rather whether it's possible for you to get married and go live with him in the US?

    Hmm. Since your fiance is not a US citizen, K1 is out. To the best of my knowledge, I-130 requires that the US spouse be a US citizen or permanent resident, so that's out. You might have to wait until your fiance gets permanent residency, and then file for the I-130...
