My question involves real estate located in the State of: New Jersey
I purchased my home three years ago. The property is fenced in, with the fence shared on both sides. We were told by the former owners that when the neighborhood was built (approx. 14 years ago), a number of neighbors purchased the fence in a group in order to get a discount. The fence is now getting old, and I want to replace. Unfortunately, there was a falling out with one of our bordering neighbors, and we'd rather not even approach them about purchasing a new fence or sharing the cost. The survey that was completed when I bought the home shows that while the fence does follow the property line, it is actually on my property. I should also note that none of the original homeowners are still around.
Do I own the fence, since it is on my property? Can I take it down to put up a new one?
