    Default Neglect of a Pregnant Minor

    My question involves child abuse or neglect in the State of: Flolrida

    I have a niece who will be 17 in August, she is 6 months pregnant. She is living with her mother, stepfather, and the father of the unborn child (he is 18). My sister and her husband have been in trouble with the law, and sister is currently "hiding" out from a vop, both have an addiction to cocaine and pills. My sister acquired food stamps because of my niece and I found out tonight, she is selling them, in trade for at least-pills. My niece is stuck her father doesn't want her with him, and my sister won't allow her to go anywhere else, is this child neglect or abuse if my niece isn't getting the food (well alot of hot dogs she says) for her baby to be healthy? Will my niece, or the babies father be in trouble when I call DCF? Thanks for any help anyone can give.

    Why would they get into trouble? You haven't indicated that they've done anything wrong.

    Well, could my niece be in trouble for not saying anything to anyone about what is going on? And the babies father for getting her pregnant in the first place, even though, my sister did allow him to move into her home with her daughter being 16.

    Here's what you can do:

    If your sister has a warrant out, you can tell police or her probation officer where to find her.

    If she is mis-using the food stamp system, you can report that to both police and to the WIC program.

    Neither of which is likely to change much for your niece. Her mother will be back home after a VOP violation pretty quickly, and selling or trading of the food stamps, although illegal (and IMO immoral) isn't something that is going to result in a sting operation, and thus, isn't likely to end in arrest or other sanction unless they decide to openly confess.

    If she's being fed daily, that's typically enough to satisfy CPS. They're not going to compare her daily intake to a nutritional pyramid, even though she's pregnant. Your niece HAS a "baby daddy", and technically HE is the one who should be on the up and up to supporting her through her pregnancy.

    No, your niece isn't likely to get in trouble for anything - unless she TOO is doing drugs, in which case CPS could be waiting in the wings to test the baby at birth to see if there are drugs in the system and determine where to go from there based on the results.

    No, her live in boyfriend isn't likely to face any problems thanks to Florida's "Romeo and Juliett" clause in the law, coupled with the fact that her parents don't seem inclined to want to separate these two.

    Even a change in guardianship isn't likely to work in this case, because such a change would mean separating her from baby-daddy, and both she AND the parents would be likely to fight it (niece wants to stay with baby-daddy and your sister is benefitting from the food stamps) - a fight that you'll need much better causes and PROOF to be able to prevail.
