My question involves labor and employment law for the state of: Illinois
It was the end of march and I just clocked in. I work at a car dealership and I came in at 2:00 on a Saturday, my normal start time. I went into the service area where I wash and clean cars. It wasn't busy at all and so the guys that we already working, were washing a used car. I started talking to them about what they had to do today and whatnot. I went on I leaned on a filing cabinet and then I went and dried our wash cloths. Me and another porter went to walk up front, when the General Manager happened to be in the service area (for once in his life) He cut me off and told me to come to his office and then he wrote me a termination letter and didn't let me explain anything to him, he just said I don't want to hear it. I was there for 11 months, almost a year, and I was written up for stuff when I first started working such as washing my mothers car, and then I was supposedly speeding in a Chevy Aveo inside the service area. (I was going about 10-15 mph and I get yelled at, even tho their service techs go about 20-30 in their pickup trucks with big extensions. Their was one time where I got written up that I don't disagree with, and myself and another porter left a jumpbox outside on overnight. But other then that, everybody at the dealership liked me (except the gm). I'm already getting unemployment from them because the State of Illinois determined that
"The claimant was discharged from BLANK because he was standing in the service area talking to other employees"
"The term misconduct means the deliberate and willful violation of a reasonable rule or policy of the employer if the violation has harmed the employer or other employees or has been repeated by the individual despite a warning or other explicit instruction from the employer. In this case, the claimant's actons which resulted in his discharge did not harm the employer or other employees."
Sorry for the long post, I'll edit it if need be, but would I have a wrongful termination case? If i felt the need to pursue one
