    Question Prisoner Mail Violation

    My question involves criminal law for the state of: KY
    I was formerly employed as a officer and resigned because I was having a affair with an inmate. We intend to be together when he is out. I recently wrote to him and while I understand that the letter would be searched for contraband it was also read by several prison officials. A copy of the letter was also sent to my soon to be ex-husband who is not a prison employee but who does work for corrections. Does this violate 1st admentment rights or state law?

    not a chance

    state law?

    not sure.

    You do understand that all mail sent to a prison is not only subject to search for contraband, it is also able to be censored by the DOC, yes? When in prison, you lose a great many of your rights. That is just one of the penalties for being a criminal.

    I was just curious. Someone with your poor decision making capabilities was sure to lose custody of minor children.

    As your communications with the convict has no expectation of privacy, I can't see where you have a case.

    I believe you are asking more about the fact that a copy of the letter got to your exhusband.

    If that is the case then you need to speak to your lawyer about it.

    As for the letter being, opened and read. There is nothing you can do about it. Being that is a security concern of the istitution. Every prison that I have worked at. Does the same exact thing. Open letters, search letters, and read letters. If anything pertinent is found in the letter then it gets sent to the investigator that works for the prison.
