My question involves criminal law for the state of: Indiana
My former partner and I bought a running business, on a land contract.
The person who we bought it from did not want to sell the business to us until he himself had owned it for 1 year, because of tax issues. So instead my partner drew up a management contract for 6 mts. Until the business could be sold to us, with out the former owner being hit with taxes. 4 mts into the contract, the former owner decided to cancel the contract. The management contract read that we had 100% operational & directional control over the business and that the former owner had no rights to any thing any longer, he was just acting as the bank holding the note, and we were to pay him $5000.00 a month.
When we left the property we removed every thing we had bought in the time we were there. The former owner now clams that we were employees working for him and we stole $30,000.00 worth of his equipment.
Every thing we removed we payed for and we have receipts for most of it.
The police went to my partner’s home with a warrant and took all the stuff we removed.
My partner & I never formed a co. The contract with the former owner only has my partners name on it not mine. The so-called stolen items were found at My partner house not mine. As yet the police have never contacted me. My partner has been questioned twice. It’s been a month and no charges are filled at this time.
My question is, I was there when the deal made. (I signed nothing) I helped run the business, but my name is on nothing, the contract was in my partners name alone (we had a verbal agreement between My partner & I but nothing in writing) & everything was found in his house.
Is it possible the police will file charges on me, if they file charges on my former partner?
