    Default Can I File Bankruptcy Again

    My question involves bankruptcy in the state of: colorado i had filed a chapter 7 and was discharged in sept 2005 can i file another chaopter7 or can i file a chapter 13 the reason is i had surgery in jan of 09 and was out of work for 2 months i dont get paid for my time off please help what can i do i want to save my mobile home

    If you filed a Chapter 7 and received a discharge, you must wait eight years from the date of the first filing before you can file a 2nd Chapter 7.

    If you filed a Chapter 7 and received a discharge, you must wait four years before you can file a Chapter 13 and be eligible for a discharge. However, a debtor can generally file a Chapter 13 within the four year period to stop foreclosure and cure a mortgage arrearage even if that debtor will not end up with a discharge.
