    Default Removing Father and Changing Childs Name in North Carolina

    My ex-boyfriend and myself have been split up over 6 months now. When we got pregnant, we knew there was a chance the baby could belong to my ex. We had the child together, whom we thought was his from the beginning, but we had a paternity test done, and he is not. At birth my son was given his name, and he was listed on the birth certificate. So now we are going in circles to see what needs to be done. We are both willing to do whatever needs to be done to change both of these. My son will be two in October, so i need to take care of this as soon as possible. Do i need to file a court action or get a family lawyer?

    You didn't rescind within 60 days, as required by statute (NCGS 110-132), so now you (or the biological father) have to take the matter to court. Consult the statute for details.
