    Default Can I Still Get a Court Date - in Collections

    My question involves traffic court in the State of: CA

    I allowed a citation to slip into collections due to moving, and also a computer crash that lost my calendar reminder information. I had intended to challenge it in court, and I believe I would prevail. Is there any way I can still get a hearing in court?

    You certainly can... Typically, the collection agency has a small office at the court house. Simply go to the court where you were scheduled to appear and request that they schedule your case for a court appearance. That will get you in for your arraignment where you will plead guilty, no contest or not guilty and go from there.

    Also, considering the fact that you have failed to appear, might also suggest that the court has placed a hold on your driver's license with the DMV who will in turn, suspend your driving privilege until they receive word from the court that you have at least scheduled an appearance.

    Chances are your were sent notices of the hold by the court and the suspension by the DMV but assuming you moved and failed to change your address with both might suggest that you did not receive anything. And that (the "I didn't receive anything telling my license was suspended" excuse) is not a valid one if you get caught for driving with a suspended license.

    So once you get your appearance date from the court, make sure to ask them to send an abstract to the DMV to remove the license hold. Until that is done, I suggest that you not drive at all...
