    Default Rights of Seperated Spouse

    My question involves paternity law for the State of: Georgia

    My wife was pregnant when we separated and I was told that she had a miscarriage. I found out today that she had the baby in April. We have a mutual restraining order, so I cannot contact her. What rights do I have in requesting from the hospital if my name is on the birth certificate? She is with someone else now, and I do not know who's name is on certificate. I do not know childs name or sex.

    Are you intending on filing for divorce? This should all be taken up in the divorce case... this is VERY IMPORTANT as you are the legal father of this child regardless.

    Hey, yes I am intending to file for divorce, but I don't have the money right now. I just want to be able to see my child, will the hospital tell me if my name is the birth certificate?

    Probably not. You'll need the court to compel her to provide a copy of the birth certificate.

    What can I do ? Do you think the judge who presided over our civil stuff will court order a paternity test?

    one more question, I was an idiot but she had threatened abortion and I signed a paper she typed saying I would give up rights to the unborn child, we got it notarized. A lawyer told me since it wasnt filed in court it is useless. Am i ok there?

    You can file for divorce and bring up the child in the divorce case. This doesn't have to be this difficult and redundancy isn't my strong suit.

    Otherwise, contact CSE and open a child support case against yourself. Ask them to order a paternity test. It'll probably be months before it happens though.
