    Default Told Her I Will File a PPO on Her and Boyfriend. So She Filed 1 on Me

    my ex and her new boyfriend made threats to me because i said i would be seeking a no overnight geusts rule in our custody order. they continued to threaten my death and the same to anyone in my household .this would include my 10 year old son and unbelievable enough my and her 2 year old daughter. im not sure if she had thought that part of her threat out completely but it was made. i recieved almost every threat possible from her from financialy by taking me to court when i cant currently afford it to physicaly and even emotionaly. the stress got to the point that one day she came to pick our daughter up for her visitation and i told her i was tired of the threats and they had to stop. she replied by stating her boyfriend would be visiting me real soon and he would take care of everyone in my house. at this point i responded to yet another threat by saying i will simply have to get a personal protection order on the two of you. her response was fine we will get one on you too then. followed by more threats of injury and how her friends are the wives of law enforcment members and she could get a gun at any time and they had told her if she used it she would only have to say it was in self defense to get away with it. i turned my back to her as she jumped in my face and attempted to bait me and started retuning to my house when she threw the threat of "we will see just how long you have custody of our daughter and your son when your in jail all the time just wait till i start calling you in" im assuming she has been being coached by her friends to attempt to bait me and on how to see im in jail for a ppo not yet even issued. needless to say there is a hearing scheduled with her and her boyfriend both respondets, but at the same time and same hearing im a respondent aswell to her. it turns out she has made claims i threatened her life and said i would kill her. in fact earlier when she said her boyfriend would be visiting my house real soon i did make one statement. i said " if i see him driving by my house or he shows up in my house there will be consequences" where do i stand in court with this? first off all threats from her then boyfriend where made through her, me and him have never had one on one contact ever. second i do still have 1 text message with a minor threat of her giving me a message supposedly from him stating he would be visiting my house. and i do have a witness who has heard her threats on multiple occascions but he did not speak with the police on the day previously talked about. when i got back into my house that day i immediatley called 911 and made a report of her actions. i guess what are my chances of winning this and loosing this? i have a witness and 1 text and she is basicaly lieing and going to try using hearsay.

    With such a broad smattering of threats, SURELY you managed to get at least a few of them documented? Recorded? Left on voicemails? WItnesses that you can call in court? Right?

    Interesting thing about such orders, is that no matter how much foot stomping someone does to a judge, ultimately a judge wants something to BASE such an order on. Hell, for that matter I could threaten to take one out on you. Doesn't mean I have a shot at actually getting one. If she's got something to actually BRING to show that such an order should issue, then she'll have to try to make the case.

    Most people could, unless they've got a criminal record that would prevent it. And even then, criminals have lots of ways of getting guns.

    Last time I checked, being the wife of a law enforcement officer didn't qualify you as a crime scene technician, a firearms or ballistics expert, or a criminal defense attorney. Lots of people say it's self defense, but the majority of them end up behind bars, nonetheless. Since she's made the threat, it would be prudent to work on some personal safety planning.

    Again; claims, shmaims...it's gonna come down to who can SHOW the court that the other side DID x, y, or z....

    I reminds me of the "I double dog dare you" from the movie Christmas Story. This type of exchange is the exact crap that the court will get tired of in a hurry. Whichever one of you grows up first and learns to handle conflict will get more of what they want out of the situation. There's being right, and there's being happy. And the "oh yeah, well wait till you see what I do..." mentality might be right - but it's not gonna end with being happy.

    Better make sure that witness is in court. Remember, there's a difference between showing that a text message came from a certain PERSON, vs. the norm, which is only that it came from a certain NUMBER (a slight, yet important distinction).

    Having made that report gives your version at least SOME level of credibility. Courts tend to hate it when people want to spout about thousands of incidents yet at the end of the day never REPORTED any of them. That report, and your witness, will probably be key - not because of statements that they contain, but just by the fact that you bothered to GET them. Without seeing what ammo SHE'S got on her side, it's hard to give win/loss odds. Do be sure that you mention that the use of a firearm and a claim of self defense have been brought up already. Then ask the court to SPECIFICALLY include a prohibition against possession of firearms in the order.
