    Default Changing My Son's Name to My Last Name

    I would like to change my son's name to my married name. My son's real father has never really been there for my son. I don't know where to even find my son's father. I'm married now and would like to change my son's name to my married name. Would I need to Serve my son's father with court paperwork or would I only need to publish in the local newspaper and wait and see if my son's father responds? Would I be able to change my son's name to my married name?

    What state are you in?

    How old is the child?

    How is it in the child's best interest to have his named changed?

    My son is 4 years old. We live in California. It would be in my son's best interest because his father has nothing to do with him anymore and he calls himself by my last name. My husband is the only father he has ever known.

    That's not a legal justifyable reason. The court is not going to look favorably upon you because you lied to the child regarding who his father is or what his LEGAL name is. People, do me a favor. I'm sick of seeing your kids in court later on traumatized because your kids have figured out that you've lied to them for a significant part of their lives. Just stop lying to your children. You have 14 years to go, anything could happen. Besides, in my experience, judges aren't too keen on changing children's names to the names of the mother's new spouses. The rate of divorce for subsequent marriages fail at a higher number, then when you get married again, you want his name changed again and so on and so forth.

    Also, do you know where the father's family is? I believe on the CA forms, you'll need to also serve grandparents and publish notice.

    It's not lieing to the kids. If they don't know who their dad is, they don't know because the dad is a dead beat. I want to change my son's name so that he has the same last name as me. My husband wants to adopted him. Just thought that changing his name would be easier right now because I thought that you needed the sperm donors signature to do so.
    What if my son had my name to began with, does that still make me a lier to who is father is. I will tell him about his father when the time is right if I change his name or not. Who are you to say anything about what we do with our kids name. Just wanted advise, not someone to tell me I'm a lier. Just want to know if I would have to serve the dad, because I don't know where anyone is, in his family.

    You have to serve dad (not sperm donor but you YOU chose as dad) to change the child's name. Further, you may need to serve the extended family (grandparents).

    You have to serve DAD if your husband wants to adopt the child.

    If your child doesn't know that your husband is NOT his father... you lied. Or use whatever term you'd like in order to make yourself feel better but the TRUTH (some people can't handle the truth) is that you lied.
