    Default Terminated While on Workmans Comp

    My question involves workers compensation law for the state of: New Jersey

    I worked for a trucking company and was involved in a traffic acident with their truck in April.
    I got hurt and I am on workmans comp.
    Two weeks after the accident they terminated me and cancled my benifits.
    Is this legal while I am still on workmans comp.

    While you cannot be fired BECAUSE you filed a workers comp claim, you can be fired in spite of it.

    To answer your questions, we need more information.

    1.) How long have you worked for this employer?
    2.) How many employees does your employer have within 75 miles of your location?
    3.) In the 12 months immediately preceding your accident, did you work a minimum of 1,250 hours?
    4.) What reason did they give you for the termination?
