My question involves a child custody case from the State of: California
Child Support: Never missed a payment
Visitations: Never missed a scheduled visitation
Issue: All court appearances (including original filings and appearances) have been in the Los Angeles, California area (I still reside there). One year ago mom moved child (11 years old) to Michigan. I was fighting the move right up until my daughter stated she was interested in moving to Michigan (they have family there).. I dropped my case and approved the move based on discussions with my daughter and assurances from my daughter and her mother that my visitation would be honored without issues (all summer, two weeks at Christmas and 1 week at Easter - approx 25% custody).
Here we are 1 year later and the mom is trying to cut my visitations, she recently emailed stating she wanted to cut three weeks off of my visit this summer - I said no. So, she simply sent plane tickets (her turn to book flights) that cut two weeks off of the court ordered visitation. I told her that was unacceptable and to cancel those tickets and book the correct dates. She of course simply is not going to send my daughter out now.
I am ssuming I will need to file Contempt of Court paperwork and try and get my visitations enforced. While I think it is rediculious I will have to do this I am willing to go through the process as I want and my family wants to see my daughter.
Now for my question :-)
Given the mothers propesity for playing games, we could end up in court several more times unless I am willing to just throw up my arms and give up on seeing my daughter. I expect mom's next move will be to try and move the Court Venue to Michigan to place yet another obstacle in my way with trying to enforce visitations. Since I still reside near the court where all original filings took place and I would not approve any change of venue how hard would it be for her to get the court venue changed with regard to issues related to our daughter?
Knowing her devious ways I can see her moving the venue, not complying wih the ordered visitations and then trying to get more child support stating I am not seeing my daughter for the full time the court papers state I am to have her.
