    Default Help with a civil demand letter

    Hello...I recently paid a civil demand of $350 (not knowing how they got to that figure I just wanted it over with and paid of course!) I asked for a formal receipt for my payment which I received promptly. It stated something I do not fully understand and need to hear it in laymans terms please.. "The payment in full amount demanded of you releases you from further civil liability with respec to the referenced incident, but does not prevent criminal prosecution under a related criminal provision" Does this mean do something like this again and you will be prosecuted?? It seemed that when I talked to the person on the phone that paying was the end....until i read that and got worried all over again..Please advise- thanks very much.

    No, it means that if there were a prosecution pending for the shoplifting incident associated with the civil demand you paid, the payment wouldn't affect that prosecution.

    Obviously if you shoplift in the future you could be prosecuted for those future incidents.

    I know that it is obvious if it happened again I could be prosecuted !! I was just trying to follow the wording- I was unaware of the fact that I would get the same kind of letter as a person that WAS prosecuted... it must be something they have to add to each letter...thanks

    and what was the return address?? did it look like you were receiving a letter from the store or from the court?

    hi.. it ttok from Oct 9th to feb 21st!! i never got the initial letter from the stores law dept as they had the completely wrong town, state and zip on it and it was returned. When it was returned to them they turned it over to a lawyers office in NYC...they called me and asked me my address i told them and they said- soooo that is the problem and I paid them over the phone with a credit card. When I asked for a receipt I got it in about 3 business days- or maybe even 2. The letter came directly from the law office. The process takes a long time in general as I was supposed to here from someone in OCTOBER and kept calling the number they gave me at the store only to keep hearing they were backed up. I cant imagine how they messed up my address as I saw them take a copy of my license and wrote it on the form I had to sign....paper work mess I guess! It is good to keep in contact with them though if you are waiting....

    the police were not involved so I never got anything form the court- when mail gets returned they probably worry that they had been given a false address and turn ot over to a law office. I hate legal jargon so when I didnt understand that statement I got nervous:-)
