My question involves labor and employment law for the state of: South Carolina
Here is the situation.
Hey all I have a question about a conversation that took place today with my supervisor regarding maternity leave under the FMLA.
It stated with me telling her I was having more pain as the pregnancy progressed and I basically wanted to give her a "heads up" that I would probably be going on leave soon. She then asks how long I plan to stay out and she said most people stay out 6-8 weeks. I told her I didn't know just yet how long I intended to stay out (although I do- it will be the entire 12 weeks) and that I would play it by ear and then I said that under the FMLA act I was entitled up to 12 weeks, right? She then said yes if you ***need*** that long but most people do 6-8 weeks. I know under FMLA I can get the 12 weeks- not if I need them but if I wanted them. Who establishes the *need* for these?
She then tells me that while I am out I will need to call her EVERY TWO weeks to CHECK IN with her!? WTH? Have you ever heard of mess like this? I told her, "I do??, For what?" And she said so she would know how I was doing, when I was coming back, and how long I intended to be gone. I just said ok. She said she just found out this. Mind you that I am like the fourth person to go out on leave in the past 6 months and no one has had to call in like this to "report" to her.
I have been there for 7 years. I had my first dd there and didn't have to do this every two weeks. I just went out and called when I was finish with the leave and ready to come back.
I think she is pissed that I'll be out all summer and they are already short staffed. To be honest I have no intention in coming back but I can't exactly tell her that, kwim. I just graduated- I plan on trying to find something else while out on leave.
What should I do? Talk to HR Tuesday? Mention it to them? Don't say anything at all and NOT call in like that? Or should I just do as she asks?
I've tried to google this but didn't come up with anything specific relating to my situation and having to check in with her while out on leave.
