    Default Possession of Marijuana - Small Amount

    My question involves criminal law for the state of: Minnesota

    I'm 24 yrs. old and I just recieved a ticket for a small amount possession of marijuana, this is my first drug related offense and I have no other priors. I am trying to go back to school this fall and having this on my record would ruin everything especially trying to get a job! I spoke with a lawyer yesterday and he said he'd charge a flat rate of $1000 to represent me! Once I expressed that I wouldn't be making my decision right away and that money was going to play a key factor in who I choose to represent me he suddenly changes his mind and says he'd be willing to give me a "sweetheart deal" of $500 and that's only if it gets resolved after 1 court appearence. I think I have a pretty easy case, is he just high balling me? What can I expect to pay for a lawyer to represent me in this? Would it be possible for me to represent myself? Also isn't it free for me to request of copy of the police report?

    If you are USA Citizen go to court ask the judge i am sorry plead guilty pay some small fine and get court supervision for year or two after that court will dismiss the charges and you could expunge your record, Now that is the easy route.

    Else get a good attorney send thousands of dollar and fight the case in the court trial.

    If you want to plead guilty or no contest to a charge you can do that own your own and if your attorney is giving you a sweet deal of 500 that's what he will be doing. I would recommend you to go with the lawyer to get best results to reduce the charge and probation.

    Define "a small amount".

    In Minnesota, possession of less than 42.5 grams is a misdemeanor punishable by a $200 fine and sometimes a drug education class.

    While I am very much of the opinion that one should never enter a court room without representation, you certainly shouldn't enter a court room with THAT attorney.

    $500 is pretty reasonable for representation for the charge you're looking at.
    Would it be possible for me to represent myself?
    It is, but it's not a particularly good idea if you're looking to keep it off your record.

    Also isn't it free for me to request of copy of the police report?

    My ticket says "small amount MJ" - I had maybe 2 grams.

    Thank you very much for your response I will definitely continue looking around - I knew that sounded too high.

    It's not even the amt,he went at you like a used car sales men or some guy at a flea market.If you have to go to court a few times,1000 isn't too unreasonable,defintley call around. You can call that guy back and see what his plan of attack is and also call some other lawyer.Good luck.
