    Question Charge Off Electric Bill

    Been debating if I should wake a sleeping bear. I have a chargeoff dated 5-04. Its been 5 years and the amt is only $319 and I can afford to pay it. I have already sent a debt validation / PFD to the company and yet to receive anything from them.

    I know if I pay this, it will get updated and may hurt my credit. Should I just let it sit and fade away within the next 2 years?

    It may not matter. In some states, a written offer to pay can reset the SOL.

    BTW: for it to work, a DV i never sent WITH a PFD. You now have ZERO credibility to get this done.

    State is TX, and I've read that the SOL is 4 years. So the SOL has expired.

    Keep in mind that your letter, depending on the wording, can reset the SOL in TX:

    Sec. 16.065. ACKNOWLEDGMENT OF CLAIM. An acknowledgment of the justness of a claim that appears to be barred by limitations is not admissible in evidence to defeat the law of limitations if made after the time that the claim is due unless the acknowledgment is in writing and is signed by the party to be charged.
