My question involves criminal law for the state of: Indiana
My niece and I were in Kohl's yesterday and we bought and paid for several items. My niece's cart had 2 pairs of sunglasses in the side pocket that were not paid for and that she didn't notice till we got to the car. She saw them at that time and just threw them in her bag. She clearly did not mean to intentionally take them since she just got done spending over $300 on other things, but made a bad choice and just threw them in her bag instead of taking them back in. The LP officer must have been behind her in line to see the merchandise through the back of the cart, because neither one of us noticed at the time. The LP officer approached her at our car and asked her to come back inside. I sat outside. From what I gather, he made her sign an acknowledgement form that she stole the sunglasses and a trespassing form in exchange for not calling the police. He took her information and took her picture and copied her license and told her she was not allowed in a kohl's store again ever. He never said anything about a letter.
My questions are, will there be some kind of letter sent to her as a civil demand? Can they pursue charges after they already let her go? Will she have to go to court?
Also, the Kohl's store was near my home which is a different store than she usually goes to in her home town. She is 22 years old, but still shops with her mother sometimes and they go to Kohl's. Will the other Kohl's store know if she goes into the store and violates the trespassing agreement? (this is the store she got in trouble at) How do they know? Can they track it by credit card usage or are there pictures of people who have shoplifted posted in the break room. I really just don't want her to be out with her mother shopping and get arrested for trespassing for being in a Kohl's just because she uses poor judgment again and goes into a Kohl's instead of telling her mom that she can't go to that store.
