Angry Father Wanting to Give Up is Rights by Mutual Agreement

My question involves a child custody case from the State of: fl/oh
just moved to ohio from florida. the father (not a father, but the sperm donor as i call him) has not paid child support since i recieved a 50$ ck in march 0f 08. he is court ordered to pay 217$ a month. he hasn't seen my son in well over a year. he has no intrest in being any part of his life. as of right now the is a restraining order on him for me and my son and is in affect till jan.2011. him and his mother called 3 wks. ago stating he is willing to sign his rights, i have found out that this is not possiable even if we both agree on on it. he is by paternity the father but he is not on the birth certificate. what can i do to get him permentaly out of my life? can my mother step in and be the other responsiable parent to sign for him? i was told i had to have a 2nd name on the birth cert. (i only have one now) that this cant be done because the child would be concidered a "bastard child" whats any different now? he is 3k in the arreaers. he was just arrested for bodily attachment/ dead beat dad in florida and was to be held when all of a sudden we checked the florida court and jail site where it said to be released immediatly. i just don't get it. the took his licences over a year ago and he them back within weeks. what a punishment.... what can i do??

The only way to get him out of your life will be if you are married, and your husband wishes to adopt. Then, it might be possible to do a TPR and adoption.

If that is not possible, all you can do is try to ignore ex and hope that he ignores you.
