    Question Violation of Probation - Does She Go Back to Where She Was Transferred From

    My question involves criminal law for the state of: ohio
    my daughter has just transfered her felony probation from fl. to oh in feb. 09. on march 23rd a family friend was doing some auto work on her vehicle just over the state line in w.v. on the 20th she tried contacting her p.o. with no return call. she decided to leave at 4am and return right away. she was involved in an accident which put her in the trauma center in charleston. she was there for 3 days. someone called her p.o and told her she was out of state and was continusly back and fourth to fl.(this was not true). she called her p.o the day she got home and told her.one week later her p.o came to the house screaming at her, told her she was violating her and she was going back to florida. i have on my voicemail saved, her retaliating boyfriend stating he was calling her p.o etc. that was april 1st. the day she came over here screaming was april 2nd. she wanted her at the office next a.m. she went next a.m and was drug tested and told she was violated. she has since been to 2 other prob. appts to only be told she is waiting to see what fl wants to do with her. she is 5 mos. preg. and just wants to get this over. she has completed 1 out of a 3 yr. probation sentence. question: are they gonna send her back?? how long can she sit around being violated? it's very nerve racking not knowing what is gonna happen or when. will she atend court here in ohio at all?? is this all another charge? and is she facing a lot of time? we can not afford an attorney and wouldn't know where to get one if we could. please help with any advive.. thanks: confused:

    Bottom line is this. She's not being violated, she has violated the conditions of her probation.

    #1: In all cases, offenders on probation CANNOT leave the state for any reason without the P.O. and courts approval. She did and is therefore in violation

    #2: She failed a mandatory drug test, a second violation.

    If the courts find her in violation, Florida or Ohio, she could be sentenced to serve jail time that she would have served if probation was not granted. Two strikes within the first year of probation is NOT a good indicator of her finishing out her probationary obligations without incident; and the courts could agree and sentence accordingly.

    thanks for the reply however, she didint have a dirty drug test. she had meds. but had hospital list of what they gave her, she just left state, but her p.o did say violations... so we dont know. she didnt do anything else.
