My question involves a traffic ticket from the state of: New Jersey
Sitting as a passenger in my friend's car tonight we got pulled over because I pinched the head of a cigarette off outside the window. Officer didn't care that I kept the butt. It was still littering....
Looking at the ticket he wrote in the OTHER/TRAFFIC OFFENSE DESCRIPTION he states:
"Littering from MV cigarette"
In the STATUTE NO box he wrote:
39: 4-65
Here's the mistake: Statute 39: 4-65 is "Letting off or taking on persons". He should have written 39: 4-64 which is "Throwing matter from vehicle". He wrote the wrong Statute No in the box. Simple mistake. The description and the statue don't match properly on the ticket. The littering fine is $230. The letting off or taking on persons ticket is $44.
My question: Should I just mail in the $44? He did write down 39: 4-65. When they input the ticket into the computers I am assuming that they input th statute no. So if I mail in the $44 would it be good? Or should I show up in court and try to fight it?
Also, this guy was being a jerk I feel. I could see if I threw garbage out the window but the head of a cigarette. Not even the butt. $230 is a lot of money that I don't have. What kills me too is that I'm ready to quit this week. Been cutting back and down to a pack every four or five days.
