    Default Neighbor Parking Boat and RV on Shared Driveway

    Oklahoma

    From looking at the exhibit drawings he's parking them outside the allotted area of the common drive to get into his garage. They don’t prevent me from getting into my garage but they serve as a major hindrance when backing out of it. Is it legal to park these things on a shared driveway?

    When we were forced to accept the easement he only had to give up 2 square feet of his land compared to my 900.

    What legal action can I take since he doesn't seem to care that I asked him to move them?

    what does the easement grant say about parking on the easement or the general use of the easement?

    And how was this easement "forced' on you, and can you say a bit more about the exhibit?

    As jk said, we need to know a bit more about the grant.

    It doesnt mention parking at all just that we have a section of the driveway which is noted in the exhibit by a dotted set of lines or yellow bellow. This is considered the common drive area, meaning he can use my land to get into his garage and the same for me on this alloted area.

    He's parking his boat and truck on what he believes to be his side of the driveway at the front entrance and the RV at the back outside of the common drive area(yellow) inside of my property line in red. His lines are in blue. So the easement only covers this alloted area. Can he park his truck and boat if its inside the drive area? Is he allowed to park his RV on that back section where we back out into?

    well, since you didn't answer the questions, I will give a best guess answer.

    if the grant does not allow parking nor restrict it yet lists any and all of the easement for access to garages etc, I would typically see this as there is no parking allowed on the easement as that does inhibit the use of the easement as intended.

    anything outside of the easement is private property and can be used in any manner the owner desires as long as it is legal.
