Default Can We Legally Force My Step Daughter Off Of MySpace

My husband and I are not memebers of MYSPACE, but a cousin of mine recently brought to my attention that my 12 yr old stepdaughter is. She is claiming to be 15 and what is worse is that her mom knows about it because she is listed as one of her "friends." The picture that popped up for her profile was one of her wearing red high heels and laying down in a provocative pose. We almost had a heartattack! We are going to speak to her and her mother about it, but is there a way we can legally make sure that she acts responsibly and takes the website down?

    1. Eligibility. Use of the MySpace Services and registration to be a Member for the MySpace Services (“Membership”) is void where prohibited. By using the MySpace Services, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 13 years of age or older; and (d) your use of the MySpace Services does not violate any applicable law or regulation. Your profile may be deleted and your Membership may be terminated without warning, if we believe that you are under 13 years of age, if we believe that you are under 18 years of age and you represent yourself as 18 or older, or if we believe you are over 18 and represent yourself as under 18.
Contact MySpace and have her TOSed.

Of course, if her mother is stupid enough to allow the child to have such a profile, you'll probably have to keep doing it for a while.

    from LRM's link
Here are some important rules to keep in mind:

    • People under 13 years old are not allowed to have MySpace profiles. Period.
If any of the above applies and you'd like us to remove or review your son's or daughter's profile, please Email us at parentcare@support.myspace.com. This is the only way to initiate a review. Be sure to provide us with your child's friend ID or Email address (the one he or she used to sign up for MySpace) when you write us so we can check out his or her profile.
apparently somebody lied to the Myspace folks.
