    Default Jail Phone Calls

    My question involves a child custody case from the State of: Florida

    I would like to know how to obtain outgoing recorded phone calls of my ex-wife while she was incarcerated at 2 different jail facilities in Florida. I would like to use the recordings to adjudicate my claims that my ex-wife has a psychological disorder that may inhibit her ability to co-parent. I have obtained the recordings from one of the jails without a problem; however, a Sargaent at the second jail (different county) said that they will only comply with a court order or at the request of a state attorney. I don't know if this is true, but the Sargaent also said that if my attorney issued a subpoena, they still would not release the recordings? Any suggestions? Thank you.

    Just out of curiousity, who is the expert witness who will be testifying that whatever she said is consistant with a psychological disorder? How long ago was she diagnosed, and who did that evaluation? Will your witness be conducting an independent psychological evaluation on her?

    She has not been diagnosed yet; we just filed a motion requesting the court to order a psychological evaluation on her by a qualified psychologist. The psychologist would serve as the expert witness.

    You will need to subpoena the recordings. Once they are srved, if they do not produce the recording your attorney would need to file a motion to compel.
