    CAN your employer sue you? Sure, anyone with a filing fee can sue for anything.

    Can your employer sue you SUCCESSFULLY? That depends on whether or not he can prove his case. WERE you negligent? If not, then he'll lose.

    As long as he's only threatening suit, don't worry about it. If you are actually served, get an attorney ASAP.

    Suit has been filed and served. Isn't there a law (Labor Code?) that says an employee cannot be sued by an employer for the employer's damages as a result of negligence of the employee? I've never heard of an employer suing an employee for the employee's failure to do something within the scope of the employee's employment.

    I am not familiar with every labor code your state offers. But if suit has already been filed and served, you need an attorney yesterday regardless of whether he "can" sue you or not. In fact, it's kind of pointless to ask if he "can" sue you since he already did. Consult local counsel.
