    Default Filing a Counterclaim in Small Claims Court

    My question involves business law in the state of: NJ

    I have a small claims action against me for $200 and yes I am filing a counter. After calling my county courthouse I was told that in NJ you must file the action in the county of the defendant. I called the other county's courthouse and they confirmed this to be true and they told me I can write a letter to the court house to have it dismissed based on this.

    I have one shot at this and want to have it dismissed, I do not care that they can come to my county and re open the suite I am fully prepared for that.

    Should I site the law in regards to incorrect venue and if so are there any statutes or cases I can site to make my case stronger?

    I am searching the internet but I am sure someone knows the best way to write this letter.

    Any help is greatly appreciated.
